Mincov Law Corporation’s “Shining Star” Contest
Contest Rules
Mincov Law Corporation’s “Shining Star” Contest (the “Contest”) is a YouTube video contest intended to reward talented children from 4 to 14 years old. It is open to all lawful residents of British Columbia, Canada who are between the age of 4 and 14 years old and are duly represented by their parents of guardians, excluding children of Mincov Law Corporation’s owners or employees.
Compliance with Rules
The Contest will be administered in accordance with these rules (the “Contest Rules”), which are not subject to amendment except by Mincov Law Corporation or Andrei Mincov, as the case may be, (collectively, the “Organizer”) in the Organizer’s sole discretion.
By entering the Contest, each contestant agrees to comply with the Contest Rules. In the event of any conflict between anything in the Contest Rules and any information in any other materials relating to the Contest, the Contest Rules shall govern.
No Purchase or Donation Necessary
No purchase or donation is necessary to enter the Contest or to win a prize.
Contest Closing Date
The Contest starts on March 1, 2012 at 12:01 a.m. Vancouver time and closes on April 30, 2012 at 11:59 p.m. Vancouver time (the “Contest Period”).
Prizes
Unless additional prizes are added, of which a separate announcement may be made at any time, there will be one prize available to be won as follows: the Contest winner will be eligible to select from one of the following three options:
(i) one of the offers made available by various businesses or institutions at the time the winner is announced. The available offers are listed on the Organizer’s website at http://mincovlaw.com/contest1/prizes;
(ii) a different “dream prize” suggested by the Contest winner, subject to its availability and the Organizer’s sole discretion. The Organizer, in its discretion, reserves the right to post your “dream prize” on the Organizer’s website at http://mincovlaw.com/contest1/dreamprizes to increase the chances of its delivery in case the child who requested the “dream prize” wins the Contest; or
(iii) a monetary prize of $500.
All prizes must be accepted as awarded.
The Organizer will select the Contest Winner (see How to Win) on May 7, 2012 at 1 p.m. at 300-1055 W. Hastings St. in Vancouver, British Columbia. The Contest winner will be notified by telephone or e-mail.
The Contest winner will receive the prize within two weeks after receipt by the Organizer of completed Winner Release from the Contest winner and verification by the Organizer that the Contest winner has complied with all Contest Rules. The Contest winner will be invited to receive the prize in person to the Organizer’s office at 300-1055 W. Hastings St., Vancouver, BC, V6E 2E9, Canada. Alternatively, if the Contest winner cannot or does not want to receive the prize in person, it will be delivered to the Contest winner by mail.
During the Contest Period, the Organizer will be posting all entries of Contest participants on the Organizer’s website at http://mincovlaw.com/contest1/entries and subpages thereof if necessary. The Organizer will also be updating the information about the prizes offered by various businesses and institutions that will partner with the Organizer to provide the prize to the Contest winner.
How to Enter
The Contest is open to all lawful residents of British Columbia, Canada who are between the age of 4 and 14 years old and are duly represented by their parents of guardians, excluding children of the Organizer’s owners or employees.
Contestants enter the Contest by creating and uploading a video of the Contest participant demonstrating his or her abilities to YouTube (http://youtube.com) and registering as an entrant on the Organizer’s website at http://mincovlaw.com/contest1/newentry before the end of the Contest Period.
Contestants may sing, play musical instruments, dance, read, act, do sports, or whatever else that they (or you as their parents) consider their important achievements.
In exchange for a chance to become the Contest winner, each contestant by registering an entry, agrees to grant and hereby grants to the Organizer, the Organizer’s assignees or licensees, or their respective agents or representatives, parents, subsidiaries, affiliated companies, advertising and promotional agencies and representatives, and each of their respective officers, directors, shareholders, employees, agents or other representatives (“Affiliated Parties”) an irrevocable perpetual, worldwide, royalty-free, non-exclusive, transferable license to use the YouTube video associated with the entry, by any means and in any form, including to reproduce (including on the Organizer’s YouTube channel and website), distribute, perform, communicate and make available to the public, including in the Organizer’s promotional materials.
The rights and defences granted to Affiliated Parties under these Contest Rules are subject to the Organizer’s approval and cannot be enforced by the Affiliated Parties against the Organizer in the absence of such approval.
There is no limit on the number of entries, provided that each entry and contestant complies with all Contest Rules.
Technical Criteria
Contestants may submit one or more videos to the Contest. Each video submitted for consideration must meet the following technical criteria:
(a) be specifically created for the Contest, which must be confirmed by the Contestant stating on camera words such as “This is for the Mincov Law Corporation’s ‘Shining Star’ contest” or “This is my submission for the Mincov Law Corporation’s ‘Shining Star’ contest”;
(b) portray the child who enters the Contest performing an activity showing his or her talents or achievements;
(c) not be filmed by a third party other than the person making the entry on the Contestant's behalf, unless such third party has assigned, in writing, all copyright in and to such a video to the Contestant or the person making the entry on the Contestant’s behalf;
(d) be non-commercial (i.e., it cannot advertise any product or service);
(e) comply with YouTube’s Terms of Service, available at http://www.youtube.com/t/terms and community guidelines, available at http://www.youtube.com/t/community_guidelines;
(f) not exceed 10 minutes in length;
(g) be formatted and encoded in accordance with the requirements listed on the YouTube Website available at http://www.google.com/support/youtube/bin/answer.py?answer=57924&cbid=-1n9u1ginv5z3y&src=cb&lev=index; and
(h) have the YouTube embedding functionality turned “on” and cannot be set to “private.”
Prohibition on Video Content
To be eligible, a video must not:
– contain, depict or refer to any crude, vulgar, obscene, sexually explicit, disparaging, discriminatory, offensive, illegal or otherwise unsuitable language, activity or other content;
– contain, depict or refer to any content which disparages or refers negatively to any person or entity; or
– contain any content that violates any third party’s intellectual property or any law or any third party’s rights,
all as determined by the Organizer in its sole discretion.
The Organizer may disqualify any video entry if it determines, in its sole discretion, that the video does not comply with these eligibility requirements or otherwise with these Contest Rules.
How to Win
In order to win a prize, an entrant must comply with the Contest Rules, including: (i) uploading a video meeting the requirements listed in these Contest Rules to YouTube, (ii) registering as an entrant on the Organizer’s website at http://mincovlaw.com/contest1/newentry, (iii) becoming the Contest winner by having their YouTube video chosen by Andrei Mincov, in his sole subjective discretion, as the video that demonstrates the greatest talent and achievement.
Skill Testing Question and Winner Release
Submission of videos will be deemed to satisfy the legal requirement that contestants answer a skill testing question. The potential Contest winner(s) must also, before receiving any prize:
(i) complete and sign the Organizer’s Declaration of Eligibility, Liability and Publicity Release (“Winner Release”), including declaring and confirming the entrant’s compliance with the Contest Rules, releasing the Organizer and the Affiliated Parties from all liability in relation to the Contest and the prizes and consenting to the use of the video, their personal information, including their name, photograph and city, for promotional purposes and
(ii) comply with all Contest Rules, all as determined in the sole discretion of the Organizer, whose decision shall be final.
Failure to Comply with Contest Rules
In the event a potential winner cannot be contacted by phone, does not sign and return the Winner Release within two weeks of being sent by the Organizer or does not otherwise comply with any Contest Rule, all as determined in the sole discretion of the Organizer, whose decision shall be final, the Organizer shall have the right to disqualify the potential winner and select another potential winner, who must also satisfy all Contest Rules in order to win a prize.
Odds of Winning
The odds of winning will depend on the number of eligible entries received.
Governing Law
This Contest will be governed by the laws applicable in British Columbia.
Correspondence
The Organizer reserves the right not to engage in correspondence with any of the contestants except with the potential Contest winner(s).
Management of Video Content
The Organizer reserves the right to: (i) disqualify any contestant whose video content is offensive, obscene, rude, defamatory, illegal or otherwise deemed inappropriate by the Organizer for any reason whatsoever, in the Organizer’s sole discretion, whose decision shall be final (“Disqualification Grounds”) or (ii) remove any content from its YouTube Channel or any other Internet website, blog, Facebook page or any other media, electronic or otherwise, based on the Disqualification Grounds.
Technical Problems or Printing Errors
Each contestant is solely responsible for ensuring that their video is properly submitted as described in these Contest Rules. The Organizer and the Affiliated Parties are not responsible for any lost, delayed, misdirected, illegible, incomplete, damaged or undeliverable entries or videos, or any delay or failure to transmit, process, receive or consider entries or videos.
The Organizer and the Affiliated Parties accept no liability whatsoever if for any reason the Contest is not capable of operating as planned due to: (i) technical problems of any kind, including, but not limited to computer viruses, bugs, unauthorized tampering, unauthorized intervention, lost, unavailable or unreliable network or Internet connections, delayed or garbled computer transmissions or hardware or software problems, (ii) printing errors on any materials created or distributed in relation to the Contest including, but not limited to, entry forms, Contest Rules or any marketing materials including any online or electronic materials or (iii) any other reason, as determined in the sole discretion of the Organizer.
The Organizer reserves the right to disqualify any individual found tampering with the Contest in any way whatsoever including, but not limited to, tampering with the entry forms, any related electronic or other equipment, any videos entered in the Contest or any other participants in the Contest.
The Organizer may, by publication as soon as possible on the Organizer’s blog at http://mincovlaw.com/blog and on the dedicated announcements page at http://mincovlaw.com/contest1/announcements, withdraw or amend the Contest at any time in the event of a production, printing, technical or other anticipated problems or irregularities of any nature whatsoever, or for any other reason in the Organizer’s sole discretion.
The Organizer and the Affiliated Parties are not responsible for any entry form, in any medium including electronic media, which fails to get entered, is lost, damaged, misdirected, ineligible or is not received by the Organizer for any reason, technical or otherwise, whether or not due to the fault of the Organizer or of any other person.
Personal Information and Publicity
By participating and accepting a prize, each winner grants to the Contest Promoters and their agents and representatives, and agrees to confirm that grant in writing in the Winner Release, the right to print, publish, broadcast, transmit and use, worldwide in any media now known or hereafter developed, including, but not limited to, the World Wide Web, any of the Contest Promoters’ Internet websites, including their blogs or Facebook pages, at any time(s), the winner’s name, likeness, portrait, picture, photograph, voice, video camera footage, city or town, YouTube entry video(s) or biographical information as news or information and for promotional purposes without compensation or review.
Contestants agree to grant and hereby grant to the Organizer and the Affiliated Parties an irrevocable perpetual, worldwide, royalty-free, non-exclusive, transferable license to use all entry videos or any fragments thereof, including in combination with any other videos, by any means and in any form, including, without limitation, to reproduce (including on the Organizer’s YouTube channel and website), distribute, perform, communicate and make available to the public, including for the purposes of operating the Contest, promoting the Organizer’s charitable fundraising efforts and awarding prizes. To the extent moral rights can be waived in the applicable jurisdiction, authors of the videos waive their moral rights to their videos. To the extent not covered by the waiver of moral rights or if such waiver is not permitted by the applicable legislation, authors of the videos participating in the Contest allow the Organizer and the Affiliated Parties, to determine whether the video will be used anonymously or with indication of the video’s author’s name or pseudonym. To the extent not covered by the waiver of moral rights or if such waiver is not permitted by the applicable legislation, authors of the videos participating in the Contest declare and warrant that they will not consider any use of the videos by the Organizer or the Affiliated Parties, including absence of any such use, as damaging the video’s author’s reputation or any changes that may be made to the videos as detrimentally deforming the author’s work.
Any entry that is fraudulent, late or otherwise fails to meet any of the requirements of the Contest Rules will be rejected and ineligible for entry. Any person abusing the entry policy will be disqualified.
